요약 | While gender inequality in the Thai employment market is pervasive, deep-seated, and complicated, the Thai legal system provides rather limited protections against gender inequality in the workplace. Moreover, the conception of gender equality and sex discrimination are not well embedded in the Thai legal system. The aim of this study was to find out how the meaning of sex discrimination in employment should be conceptualized. This study compared the conceptualization of sex discrimination in employment in the U.S. legal system with the Thai legal protections against sex discrimination and explored American feminist critiques of the U.S. legal concept of sex discrimination to find out if the concept has been effective. |
요약 | This study finds that an explicit anti-sex-discrimination provision must be enacted in the Thai labor law and a well-developed definition of sex discrimination must be incorporated into the Thai legal system. This is to ensure that the anti-sex-discrimination provision and the definition of sex discrimination will be a directive for administrative agencies and courts in enforcing the law and will be a legal premise for individual plaintiffs in tort litigations. This study also finds that, to achieve real gender equality in the workplace, we must admit that biologically and socially constructed differences between women and men actually exist, and thus, special protection measures and accommodation of differences are needed. |
